These Terms of Service ("Terms") govern your access to and use of the Stones mobile application and related services (collectively, "the App"), operated by 1000888462 Ontario Ltd., a corporation registered in the Province of Ontario, Canada, operating as CJS Digital ("we", "us", "our", or "CJS Digital"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About Stones

Stones is a faith community application designed to help users remember and share moments of God's faithfulness — testimonies ("stones") and prayer requests — and to support one another through prayer and encouragement. The App is offered free of charge with optional donation support.

2. Eligibility & Account Registration

• You must be at least 13 years old to create an account. Users aged 13–17 should have permission from a parent or guardian.
• You must provide a valid email address and accurate display name when creating an account.
• You are responsible for keeping your account password confidential and for all activity that occurs under your account.
• You may have only one active account at a time.
• If you believe your account has been compromised, contact us immediately at info@cjsdigital.ca.

3. User Content

"User Content" means any text, photos, scripture references, prayer requests, encouragements, circle names, or other content you create or upload to the App.

• You retain ownership of your User Content.
• By posting User Content, you grant CJS Digital a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your content within the App as necessary to operate the service.
• This license ends when you delete the content or your account, except where retention is required by law.
• You represent that you own or have the right to share any User Content you post and that it does not infringe anyone else's rights.
• You are solely responsible for your User Content.

4. Community Standards

Stones is a faith community. To keep it safe and welcoming, you agree not to post or transmit content or engage in conduct that:

• Harasses, bullies, or threatens any user, including via prayer requests or encouragements
• Discriminates against any person or group on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic, or constitutes hate speech
• Is sexually explicit, pornographic, or sexually suggestive in nature
• Contains nudity or graphic violence
• Exploits or endangers minors in any way
• Promotes self-harm or suicide, or glorifies dangerous behaviour
• Impersonates another person, organization, religious leader, or entity
• Spams the community with repetitive, irrelevant, or promotional content
• Promotes commercial products or services, multi-level marketing, religious products for sale, or fundraising unrelated to your own personal testimony
• Solicits personal information from other users (phone numbers, addresses, financial information, etc.)
• Distributes malware, phishing links, or attempts to compromise the App's security
• Violates any law or regulation, or facilitates illegal activity
• Misrepresents testimony, faith experiences, or scripture in misleading ways for personal gain
• Provides medical, legal, financial, or psychological advice as if from a qualified professional
• Infringes the intellectual property rights of others (e.g., posting copyrighted material without permission)
• Uses automated tools or bots to interact with the App in any way not provided by the App's interface
• Attempts to access data or features you are not authorized to use, including circles you do not belong to

We reserve the right, but are not obligated, to review, remove, or restrict access to any User Content that violates these Terms, and to suspend or terminate the accounts of users who violate these Terms.

5. Crisis & Mental Health Notice

If you observe a prayer request or other content from another user that suggests imminent danger to themselves or others, please contact your local emergency services and report the content to us at info@cjsdigital.ca.

6. Donations & Payments

• The App is free to use. Some features (e.g., a higher email-invite limit) may in the future be tied to a paid plan; if so, terms will be presented clearly at purchase.
• Users may optionally donate to support the App's operation and ongoing development.
• Donations are processed by Stripe, Inc. and are subject to Stripe's own terms and privacy policy.
• All donations are non-refundable. By making a donation, you acknowledge that you do not expect a refund under any circumstances.
• Donations are not a fee for service. Donations are not tax-deductible charitable receipts unless 1000888462 Ontario Ltd. specifically issues one to you in writing.
• If you believe a donation was made in error (e.g., fraudulent charge), contact us within 7 days and we will investigate. Fraudulent activity should also be reported to your bank or card issuer.

7. Intellectual Property

• The App's name, logo, design, code, branding, and original content (other than User Content) are the property of 1000888462 Ontario Ltd. and protected by Canadian and international intellectual property laws.
• You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the App or its content except as expressly permitted in writing by us.
• Scripture references quoted within the App are used under the public-domain or fair-use provisions applicable to the translation cited.

8. Account Termination

By You

You may delete your account at any time via Settings → Delete Account within the App. Deletion is immediate, permanent, and irreversible. All your stones, prayer requests, encouragements you sent, circle memberships, owned circles (and their members), follows, badges, and account record are permanently removed.

By Us

We may suspend or terminate your account, with or without notice, if:

• You violate these Terms or the Community Standards
• You engage in activity that harms other users, the App, or third parties
• We are required to do so by law or by a regulatory authority
• Your account is inactive for an extended period (we will attempt to notify you first by email)
• We discontinue the App (we will provide reasonable advance notice and an opportunity to export your data)

If your account is terminated by us, the same data deletion described above applies.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by law, 1000888462 Ontario Ltd. disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted operation.

Specifically and without limitation:

• Stones does not provide and is not a substitute for medical, psychiatric, psychological, pastoral, spiritual, legal, financial, or other professional advice or services.
• Content posted by other users represents their personal views and experiences. We do not endorse, verify, or guarantee the accuracy of User Content.
• We do not guarantee that other users will pray for your prayer requests, respond to your stones, or engage with your content in any way.
• We do not guarantee that the App will be available without interruption, error, or data loss.

10. Limitation of Liability

To the maximum extent permitted by applicable law, 1000888462 Ontario Ltd. and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of (or inability to use) the App.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the total amount you have donated to us in the twelve months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent those jurisdictions' laws apply, the above limitations may not apply to you, and our liability will be limited to the minimum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless 1000888462 Ontario Ltd. and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (i) your use of the App, (ii) your User Content, (iii) your violation of these Terms, or (iv) your violation of any rights of another person or entity.

12. Third-Party Services

The App relies on third-party services including but not limited to Supabase, Cloudinary, Expo, Render, Stripe, and Resend. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the acts, omissions, or content of any third-party service provider.

13. Modifications to the App

We may change, suspend, or discontinue any feature of the App at any time without notice. We are not liable to you or any third party for any modification or discontinuation.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and 1000888462 Ontario Ltd. agree that the exclusive jurisdiction for any dispute arising out of or relating to these Terms or the App shall be the courts of the Province of Ontario, located in Welland or the Niagara Region, and you consent to the personal jurisdiction of those courts.

Before pursuing formal legal action, you agree to first contact us at info@cjsdigital.ca with a clear description of the dispute and proposed resolution, and to allow at least 30 days for a good-faith effort at informal resolution.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be communicated through the App or by email. Your continued use of the App after a change constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any in-App notices, constitute the entire agreement between you and 1000888462 Ontario Ltd. regarding the App, and supersede any prior agreements.
